I refer to the membership of Mr Charlie Smith on the Aboriginal Cultural Material Committee, and I ask -
(1) Is it true that Mr Smith runs a company known as Weymul Contractors?
(2) Is it true that the Ngarluma Group insist on surveys being managed by Weymul Contractors?
(3) Please detail the results of all Section 18 applications of the
Aboriginal Heritage Act 1972
regarding Ngarluma land?
(4) Was Mr Smith present and did he participate in any decisions regarding Ngarluma land?
(5) Has Mr Smith been present in meetings with mining companies representing the Ngarluma people?
(6) Has he insisted that surveys be done through his company (prior to the Section 18 applications)?

(2) There is not one "Ngarluma Group". There is no empirical evidence to support the Member's question, however, the Department of Indigenous Affairs (DIA) understands that the Ngarluma Aboriginal Corporation, the prescribed body corporate established pursuant to the Native Title Act 1993 to hold the native title rights and interests of the Ngarluma native title holders, has endorsed a company called Weymul to manage the corporation's heritage survey work. Other Ngarluma groups endorse particular heritage consultants to conduct work on their behalf.
