172. Hon KATE DOUST to the
Leader of the House representing the Minister for Finance:
I refer to the development of the Governor Stirling Senior
High School oval that was contracted out by Building Management and Works.
(1) Will
Building Management and Works issue a certificate of practical completion to
Pindan Pty Ltd as the head contractor appointed by BMW?
(2) If no to (1) —
(a) why not; and
(b) does the
minister understand that subcontractors are going without pay as a direct
result of this action?
(3) How many
complaints of non-payment has the office of Building Management and Works
received from subcontractors who worked on the state government–funded
project?
(4) How many
subcontractors are yet to get paid for works completed on the Governor Stirling
Senior High School oval?
(5) What is
the state government doing to ensure that all subcontractors who worked on the
Governor Stirling Senior High School oval have been or will be paid?

I thank the honourable member for some notice of the
question.
(1) Yes. A
certificate of practical completion will be issued to Pindan when the works
have been completed to Building Management and Works' satisfaction. A
meeting between Building Management and Works and Pindan is being held this
afternoon to further progress the resolution of outstanding issues.
(2) Not applicable.
(3) There have
been three. Building Management and Works follows a detailed process to
investigate subcontractor non-payment complaints, which involves working with
subcontractors to understand the nature of the issue and the extent of the
alleged non-payment and working with the relevant head contractor to explore
and, when possible, resolve the issue. This process is currently underway.
(4) This
information can be obtained only from the head contractor, Pindan. Building
Management and Works does not pay moneys directly to subcontractors. All moneys
due to the head contractor have been paid.
(5) Before a
final payment is made to the head contractor, it will be required to provide a
statutory declaration that all moneys due and payable to subcontractors have
been paid.
