I refer to tabled paper 4340, the government's
response to the ''Report on the Operation and Effectiveness of the
Construction Contracts Act 2004 (WA)'', and the comment on
recommendation 10.
(1) What
consultation will be undertaken to assess the value of expanding the
Construction Contracts Act to incorporate mining activities?
(2) For how long will this
consultation take place?

I thank the honourable member for
some notice of the question.
(1) Professor
Evans recommended that the current exclusion of certain mining activities from
the definition of ''construction work'' in section 4(3)(a) and
(b) of the Construction Contracts Act 2004 be removed. While the state
government notes the intent of this recommendation, very limited consultation
was undertaken with businesses operating in the mining and resources sector
during Professor Evans' review. Therefore, the state government will
undertake further consultation with mining and resource companies and any other
interested organisations, such as the Chamber of Minerals and Energy, to
determine the value and support among the sector for extending the operation of
the Construction Contracts Act 2004. The method for the consultation is yet to
be determined.
