(1)-(5) In January 1992, Mr Peter Goss, President of the Leschenault Railway Preservation Society Inc (LRPS) informed the Commissioner of Railways that LRPS was to amalgamate with the Australian Railway Historical Society (the Society) and that all of LRPS's assets and finances were to be vested in the Society. As a result, steam locomotive "Leschenault Lady" transferred from LRPS to the Society. In mid 1992, the then Minister for Transport approved of ownership of all of the exhibits on permanent loan at that time to the Society being passed to the Society. The only condition of the transfer of ownership to the Society was in regard to future ownership of the various items in the event of dissolution or winding up of the Society. In March 1995, the Society advised that the status of the "Leschenault Lady" required clarification and in October 1995, Westrail transferred ownership of "Leschenault Lady" to the Society under the same condition that applied to all other items of rollingstock transferred to the ownership of the Society. Accordingly, the Government is not in a position to direct the Society to make the "Leschenault Lady" locomotive available to the Boyanup Vintage Museum. The matter is an issue for negotiation between the Society and the Boyanup Vintage Museum.
