(a) can the Minister confirm that the Western Australian Planning Commission is the determining authority for this application, and if so, what is the status of the application;

(a) Under section 16 of the Metropolitan Region Scheme, the Western Australian Planning Commission is the sole determining authority of the application to commence development on Lot 738 Bournemouth Crescent, Wembley Downs. The application has been determined and was approved, subject to conditions.
(b) Prior to forwarding its recommendation to the Western Australian Planning Commission, the City of Stirling carried out community consultation in accordance with provisions of its Town Planning Scheme. Council sent a letter to all surrounding property owners inviting comment regarding the development proposal within 21 days. These submissions were considered as part of the Western Australian Planning Commission assessment of the application.
(c) Given the building will accommodate more than seven permanent residents who do not comprise a single family and no medical services will be located on the site, the use fits under the definition of residential building as contained in the Residential Design Codes.
