(d) – (e) An MIR package is offered on the following conditions. That the recipient shall:
1.
keep confidential all information related to the offer and acceptance of this package, including the circumstances in which
this offer is made;
2.
not use any of the information contained in this letter for a purpose other than the negotiation of this MIR package;
3.
not subsequently engage in direct employment for the Government, nor shall you or any other corporation of which you
are a Director supply any services to the Government for a period equivalent to the payment amount without the
Premier's personal approval;
4.
agree (subject to the provisions of any other Act) not to publicly express any criticism in relation to matters relevant to
the administration of the Agency (including the performance of the Minister responsible for that Agency) for which you
worked immediately prior to taking the MIR package for a period until the writs are returned for the next general State
election, or 12 months from the date of accepting the package, whichever is the greater; and
5.
Nothing in condition (4) obliges you to treat information as confidential where you are required to reveal the disclosed
information pursuant to a provision of a statute or other law or where you are required to reveal or disclose information
by a court or by virtue of an order given to you by the Government.
