I refer to application number 13/16195, 04/00766 and 04/12289 originally made on 6 November 2003 by MJ Lundstrom for land situated and described as Lot 29 Tredrea Place, Myalup. This refers to extractive industry limestone, Shire of Harvey District Planning Scheme No. 1 and Notice of Planning Permission and ask -
(1) Can the Minister confirm that the Shire is allowed to ask for a levy of $0.10/m3 of extracted material, paid six months in advance, being paid to Council to assist in the maintenance and upgrade of Taranto and Tredea Roads?
(2) Is this the equivalent of a road tax?

I am advised that in granting planning approval a local government may impose any conditions it considers are appropriate, and that similar conditions have been imposed by the Shire on other extractive industry operations within its district. (2) I am not the Minister for Planning and Infrastructure and therefore am unable to comment on matters outside of my portfolio responsibilities. I reiterate that the levy is intended to assist with the damage caused by heavy vehicles transporting limestone material from the quarry site
