(1) Are the proponents of the Smith’s Beach development engaging in misleading advertising by continuing to seek registrations of interest from people for the purchase of land and / or buildings at Smith’s Beach, in spite of the project withdrawal?
(2) Will the Minister act to have these misleading advertisements and statements withdrawn from the proponent’s website?
(3) If not, why not?

(2) No. (3) The Department for Consumer and Employment Protection has been examining complaints about the Internet advertising of the Smiths Beach development proposals. The Department does not believe that the website contains information that is misleading under the provisions of the Fair Trading Act. The Department is continuing to monitor the website and the changing circumstances of the development proposals.
