79. Hon SUE ELLERY to the Minister for
Education:
I refer to physical bullying of
students by other students.
(1) Will the
minister table the policy and protocols applying in public secondary schools
where there are assaults by students on other students that result in police
charges being laid against the offending student?
(2) Is the
minister aware of concerns that the policy of banning students from filming
fights means that evidence that could be relied upon in court is not available?
For example, a student at Governor Stirling Senior High School who was
suspended for breaching the policy banning filming of fights after he used his
phone to film a physical assault on one student by another, when that film
later was relied upon in court to convict the offending student?

I thank the honourable member for
some notice of the question.
(1) Public
schools respond to assaults by students against students in accordance with the
student behaviour policy and procedures. In the event that a complaint is made
to WA Police, the matter is dealt with in accordance with WA Police policies
and procedures. The department supports police in their criminal
investigations. I table the department's student behaviour policy.
(2) I am advised
that no concerns have been raised regarding the Department of Education's
policy relating to the uploading and distribution of students filming student
fights. [See paper 3851.]
