I refer to the matter of Ormonde Waters and the administration of Zyprexa leading to health problems, and I ask —
(1) Did the Minister receive correspondence from Leonard Cohen, in relation to Mr Ormonde Waters on 30 June 2011?
(2) What circumstances would need to be established before an ex-gratia payment for the administration of a drug leading to debilitating health problems would be granted?
(3) While information from Mr Rowan Davidson to Mr Waters maintains that there is no coercion in the way medication is prescribed to mental health patients, has the Minister received complaints about coercion by staff in the administration of prescribed medications?
(4) If yes to (3), what are the details of those complaints?

(1) No correspondence was received from Leonard Cohen in relation to Mr Ormonde Waters on 30 June 2011.
(2) Persons who allege negligent practice would seek compensation through a process of litigation.
(3) Patients who are required to receive treatment under the Mental Health Act 1996 do make complaints about receiving treatment without their consent. These complaints are made to clinicians and services and also referred to the Chief Psychiatrist in the Department of Health or the Mental Health Review Board.
(4) Patients treated under the
Mental Health Act 1996
frequently complain about medications they are required to take under their involuntary status because they do not wish to take those medications. The kinds of complaints will include patients' perception of side effects; disagreement with the dosage; disagreements on a particular medication; disagreement about form of administration e.g. oral or intramuscular.
