(1) I am aware that the Environmental Protection Authority (EPA) has received a Revised Development Plan for Kennedy Bay. (2-3) The EPA has previously formally assessed the Port Kennedy Regional Recreation Centre in 1989 and a Change to Environmental Conditions for the Regional Recreation Centre Stage 1 Boundary, Port Kennedy in 1994. In view of the previous formal assessments undertaken by the Authority, the EPA will determine if the Revised Development Plan for Kennedy Bay can be formally assessed. Section 38 (5 j) of the Environmental Protection Act 1986 provides that a proposal cannot be referred to the Authority more than once. If the EPA concludes that it is a proposal that can be referred, then the EPA will determine if formal assessment is warranted and if so the level of public consultation.
