MIDLAND BRICK LICENCE - APPEAL
I refer to the new licence proposed for Midland Brick in the Swan Valley. (1) Is the minister aware that this licence was advertised for public appeals by the Department of Environment and Conservation nearly one year ago now? (2) Can the minister explain why the DEC is yet to respond to the appeals made on this licence by the public? (3) Is the minister aware that Midland Brick is currently operating under the same licence that was the subject of a public appeals process in 2006? (4) Does the minister consider that procedural fairness has been applied to the statutory appeals process in this case? This matter was brought to the minister’s attention recently. (2) The Department of Environment and Conservation is analysing the appeals and will provide its advice to the Appeals Convener by the end of this week. (3) Yes. (4)-(5) The minister will consider this matter and determine the appeals when he has received the Appeals Convener’s report.
