I thank the member for the question.
The following information has been provided by the Minister for Commerce.
(1) No.
(2) Not applicable.
(3)–(4) The
powers and processes prescribed in sections 110 to 118 of the Building Act 2011
are for the purposes of issuing and effecting building orders. These powers are
conferred to the permit authorities, which, under the act, are established as
local government authorities, and, by delegation, a number of state government
agencies, including Building Management and Works in the Department of Finance.
Only a permit authority can commence a prosecution under the act.
