(1) The Department is unable to supply this information as:
A total count of the actual charges would require a manual examination of each prisoner's record.
Breaches of the rules imposed by the Smoking Reduction Plan are many and varied; from smoking in prohibited areas, to misuse of electrical appliances to light cigarettes, and prisoner misconduct arising out of instruction to comply with local smoking regulations.
Prisoners who breach any prison Standing Order relating to the Smoking Reduction Plan are initially counselled by unit staff and notations kept on their file notes. Prisoners are rarely charged as there needs to be a pattern of unacceptable behaviour prior to any punitive action being taken under the
Prisons Act 1981
.
