(1) It is a requirement of the New MetroRail city project design and construct contract that the works be designed and constructed such that damage to heritage buildings is limited to the defined level of “very slight”, which corresponds to fine cracking that can be easily treated during normal redecoration. The contractor must design and construct the temporary and permanent works, including building protection if required, and monitor and control ground and building movements in accordance with this obligation. (2) The contract requires that all building damage repairs be undertaken by the contractor. The Government will meet the actual cost of damage to the level of “very slight” from a provisional sum included in the contract price.
