MISCONDUCT REPORT RECOMMENDATIONS
313. Hon ADELE FARINA to the minister
representing the Minister for Local Government:
I refer to the ''Report on
the Investigation of Alleged Public Sector Misconduct by a Local Government
Employee in Relation to the Purchase of Management Systems Software''
released by the Corruption and Crime Commission on 19 December 2013.
(1) In light of
the recently released CCC ''Report on Misconduct Risk in Local
Government Procurement'' and the Premier's comments of 5 February
that most corruption occurs in local government, has the Department of Local
Government and Communities implemented any of the recommendations of the ''Report
on the Investigation of Alleged Public Sector Misconduct by a Local Government
Employee in Relation to the Purchase of Management Systems Software''?
(2) If no to (1) —
(a) given it has been more than a
year since the release of the report, why not; and
(b) when will a
decision be made about what action to take in relation to the recommendations?
(3) If yes to (1), what action has
been taken?

Department of Local Government and Communities has undertaken an authorised
inquiry in regard to matters concerning Mr James Trail. The report has been
completed and the matter is being considered to determine whether any further
action would be in the public interest.

(3) The
Department of Local Government and Communities has undertaken an authorised
inquiry in regard to matters concerning Mr James Trail. The report has been
completed and the matter is being considered to determine whether any further
action would be in the public interest. All the recommendations relating to
gifts are being progressed through a working group led by the Western Australian
Local Government Association. The department is a participant on that working
group. The Local Government (Functions and General) Regulations are currently
being amended to address issues raised in regard to procurement and tenders.
The Western Australian Local Government Association has also produced a more
detailed guide to information technology procurement.
