to Question on Notice No. 3442, who made the decision, and when, not to
pursue prosecution of Chevron given that the marine pest Didemnum perlucidum
was first detected on a Gorgon marine vessel in February 2012? (2) Why
did the Department fail to seek State Solicitor’s Office advice on the matter? (3) Was
prosecution considered under any power other than the Fish Resources Management
Regulations 1995, and if so, what legislation or regulation? (4) Has
the Department mounted a prosecution against any party at any time as a result
of a biosecurity incident? (5) If yes to (4), when and under what circumstances?

(1)-(3) In respect of offences under legislation administered within my portfolio in relation to this matter, it would not be appropriate for me to comment on whether or not any decisions have been made in relation to instituting prosecution proceedings.
