secretary representing the Minister for Commerce:
I refer to community
concerns around privacy, safety and dignity relating to changes to the
provision of bathroom facilities in the National Construction Code 2025.
(1) Was any consultation undertaken prior
to the new code being adopted?
(2) If yes to (1), who was consulted and
when did this consultation occur?
(3) If no to (1), why not?

question.
(1)–(3) Consultation is undertaken by the
Australian Building Codes Board (ABCB), which develops each National
Construction Code edition for all Australian states and territories. The ABCB
consulted nationally between May and July 2024 on the voluntary Deemed-to-Satisfy
pathway for all gender facilities in the 2025 edition of the National
Construction Code and released a preview draft for public comment in February
2026.
