The statutory basis for priority agriculture areas is within statement of planning policy 2.5 - in my answer to question without notice 820 I identified this statement by another number, but I did say its number had changed - agricultural and rural land use planning, established under section 5AA of the former Town Planning and Development Act 1928. It is within the portfolio of the Minister for Planning and Infrastructure. As such, the Minister for Agriculture and Food has no specific powers in respect of priority agricultural areas. (2) The Department of Agriculture and Food advises and provides assistance to local government and the Department for Planning and Infrastructure on preparation of town planning schemes, shire planning strategies and region plans and schemes to identify land of agricultural significance, including land capability and suitability for agricultural uses.
