With reference to the Burrup and Maitland Industrial Estates Agreement Additional Deed (BMIEAAD) of 16 January 2003, section 12.1 and the letter to the Minister for the Environment from the Minister for the Environment and Heritage received 1 April 2003, concerning matters of World Heritage, I ask -
(1) Can the Minister confirm that clause 12.1 of the BMIEAAD states, ‘Within three months of the date that the Commonwealth Government formally requests the views of the State to some or all of the Dampier Archipelago and the Burrup Non-Industrial Land being nominated to the World Heritage List, the State will establish a committee (‘Burrup Heritage Committee’)
to consider and report to the State (including making recommendations) as to whether a recommendation should be made to the Commonwealth Government for some or all of the Dampier Archipelago and the Burrup Non-Industrial Land to be nominated to the World Heritage List’?
(2) Can the Minister confirm that the last paragraph of the letter to the Minister for the Environment, sought discussions on the opportunity to include the Dampier Archipelago and the Burrup in a World Heritage Nomination?
(3) Given this correspondence and wording of the BMIEAAD, can the Minister advise on what date the Burrup Heritage Committee was established?
(4) If not established, why not?
(5) If established, can the Minister advise of the participating members on this committee?
(6) If no to (5), why not?
(7) If the Burrup Heritage Committee has not been established as per 12.1 of the BMIEAAD, have the parties to the agreement been informed?
(8) If yes to (7), what was their response?
