2. In the Bardi Jawi and Wanjina Wunggurr Wilinggin applications, this Government first made proposals for consent determinations in April and November 2001, respectively. In both cases the native title applicants elected to continue the litigation process and did not agree to the consent determination proposals. A revised consent determination proposal has recently been put forward in the Wanjina Wunggurr Wilinggin application, based on an assessment of the evidence given in the course of the trial of the matter. In relation to the other matters within the Shire of Derby West Kimberley, the Kimberley Land Council (the Native Title Representative Body for the Kimberley region) and the Office of Native Title in the Department of Premier and Cabinet have met, under the auspices of the National Native Title Tribunal, to agree priorities for action on native title applications in the Kimberley region generally, over the next 12 months. Along with the Bardi Jawi and the Wanjina Wunggurr Willingin applications, the Ngurrara application is an agreed priority in the Shire of Derby West Kimberley. The Noonkanbah application is also considered a priority, although the applicants in this matter are not represented by the Kimberley Land Council. 3. Discussions are continuing with the Kimberley Land Council, as the representative of the native title applicants in the Bardi Jawi and Wanjina Wunggurr Wilinggin applications, and with the representatives of the Noonkanbah applicants.
