(2) Yes. (i) a councillor at the City of Joondalup was prosecuted and convicted for publishing and distributing unauthorised election material during the 2001 local government election. The fine was $400 and a spent conviction was issued. (ii) a councillor at the City of Belmont was prosecuted for publishing unauthorised electoral material. Prosecution withdrawn when witness changed position. (iii) a councillor with the City of Perth took legal action against the Electoral Commissioner in relation to a local government matter. Prosecution withdrawn by plaintiff.
