I refer to Miscellaneous Licence 26/181, the pipeline, bunding on both sides of the pipeline and catchment pits which are linked to the bunding and pipeline on L26/181 and question without notice of which some notice was given number 145 of June 21 2001 -
(1) Is it correct that when Miscellaneous Licence L26/181 was granted, the legislation under the Mining Act for Miscellaneous Licences stated ‘No Licence shall be granted under this section unless the purpose for which it is granted is directly connected with mining operations’?
(2) If not, can the Minister explain why?
(3) Is it correct that condition number 7 on Miscellaneous Licence L26/181 states in part ‘On the completion of the life of mining operations in connection with Miscellaneous Licence 26/181 the holder shall forwith commence...’?
(4) If not, will the Minister table a copy of all the conditions on Miscellaneous Licence 26/181?
(5) Can the Minister please explain why the pumping of saline water from underground mining operations in the pipeline on L26/181 is not a ‘mining operation’ when it appears the purpose for which it was granted is directly connected with mining operations and falls into the definition of ‘mining operations’ under ‘the doing of all lawful acts incident or conducive to any such operation or purposes’?
(6) If not, why not?
(7) Can the Minister explain how the department has the ability and control to regulate, and direct that particular matters be carried out in accordance with the
Mining Act 1978
and Regulations to the pipeline, also the water which travels through the pipeline on Miscellaneous Licence 26/181 when the department has stated that it is not a ‘mining operation’?
(8) If not, why not?
(9) Can the Minister explain why his departmental officers assessed the notice of intent titled Sitewide Water Supply Rationalization dated September 1991 which included Miscellaneous Licence 26/181, the pipeline and made recommendations when the department has indicated that the operation of the pipeline is not a ‘mining operation’?
(10) If not, why not?
