(1) Can the Minister confirm that the area of land at Point Peron (the Land) earmarked for the proposed ‘Mangles Bay Marina Based Tourist Precinct’ development is still subject to the restrictions imposed by the Commonwealth in 1964 when the Land (together with adjacent land) was transferred by the Commonwealth to the State of Western Australia on condition that the future use of the Land (and the adjacent land) be restricted 'to a reserve for Recreation and/or Park Lands'?
(2) If this is not the case, will the Minister provide specific details of any change(s) to the restrictions on the use of the Land and advise whether the State considers that such changes (if any) allow the Land to be used for the proposed ‘Mangles Bay Marina Based Tourist Precinct’ development, the design of which includes a canal-based residential subdivision and inland marina?
(3) Has the State received confirmation that the Commonwealth agrees with the State's view on this issue?
(4) If yes to (3), when?
(5) If no to (3), why not?
(6) If the Land is still subject to restrictions imposed by the Commonwealth that do not or may not allow the land to be used for the proposed ‘Mangles Bay Marina Based Tourist Precinct’ development, can the Minister explain why the State Government has so far committed at least $3.7 million of public funds to the proposed development by a private sector partner?

The questions raised by the Member refer to State Government's dealings with the Commonwealth Government over land at Point Peron as far back as 1964.  Since the questions pertain to events that occurred nearly fifty years ago, the Member's questions have been referred to the State Solicitor's Office for further advice and a response will be provided as soon as that advice has been received.
