I refer to Budget Papers page 871, Outcomes and Key Effectiveness Indicators, table regarding compliance with safety and employment regulatory requirements, and ask -
(1) Why has the target for compliance for 2010-2011, been set below the 2008-2009 and 2009-2010 levels?
(2) Will the Minister please clarify the number of staff and their roles in Safety and Employment Protection?

(1) This effectiveness indicator has three underpinning measures:
(a) the department's effectiveness regarding the extent to which employers comply with the requirements of the labour relations legislation (Labour Relations division);
(b) the department's effectiveness in ensuring workplaces operate in a safe and healthy manner (WorkSafe division); and
(c) regular compliance audits on various elements of approved inspection plans to ensure that electricity and gas network operators and Liquefied Petroleum Gas (LPG) suppliers comply with their inspection obligations (Energy
Safety
division).
The WorkSafe division results are a significant contributor to this effectiveness indicator. There was a change in the method of reporting, during 2008, which consequently increased the recorded rate of non-compliance which was then reflected in the 2010/11 target (72%). In addition, when setting the 2009/10 target (82%) there was only a relatively short period of data available which subsequently proved to be an unreliable estimate of actual compliance.
(2) The Budget Target for 2010/11 for the Safety and Employment Protection service is 386 FTEs. This figure is comprised of:
· 161 staff from WorkSafe;
· 84 staff from Labour Relations;
· 55 staff from Energy
Safety
; and
· 86 staff from Corporate Services and the Office of the Director General (ie. a proportion of the total support staff in the Department of Commerce).
