Currently, 30 people in WA are subject to a custody order under the
Criminal Law (Mentally Impaired Accused) Act 1996
(WA). 7 of these are resident in the community.
(2)
The Mentally Impaired Accused Review Board's records disclose that the 23 individuals presently being "held" are currently in the following places:
· 8 at Graylands Hospital (6 of whom are under the care of the Frankland Centre)
· 6 at Acacia Prison
· 4 at Casuarina Prison
· 1 at Eastern Goldfields Prison
· 3 at Greenough Regional Prison
· 1 at Wooroloo Prison Farm

Of the accused persons
currently
managed by the Mentally Impaired Accused Review Board, the Board's records reflect an average time in custody of five years and eight months.
Of the mentally impaired accused persons held in prisons (as distinct from in Graylands), the records of the Department for Corrective Services disclose that there were 14 releases between 1 March 2001 and 14 May 2011 concerning 11 people subject to custody orders under the
Criminal Law (Mentally Impaired Accused) Act
. Among those released in that period, the average time spent in custody was one year and ten months.

managed by the Mentally Impaired Accused Review Board, the longest term of custody to date is 21 years and 7 months. Available data do not allow for calculation of the longest custody order ever served in WA.
