I refer to the Minister's decision to uphold Hanson's appeal against the findings of the Environmental Protection Authority that the proposed expansion of the Red Hill quarry not go ahead and note that in that document, the Minister states that the proponent is continuing to negotiate with the traditional owners, and I ask —
(1) Will the Minister please identify which traditional owners are negotiating with Hanson regarding the expansion of the quarry?
(2) If no to (1), why not?

(1)-(2) As previously advised, section 45(1) of the
Environmental Protection Act 1986
requires that the Minister for Environment consults with decision making authorities as to whether or not the proposal may be implemented, and if so, the conditions to which that implementation should be subject. Through this process, changes to the conditions have been identified which are currently being considered by decision making authorities. Relevantly, the Minister for Indigenous Affairs is identified as a decision making authority for this proposal, and will consider issues relating to Aboriginal heritage in responding to the issue.
As noted in answer to question 5493, the Minister for Environment has not been assisting or participating in negotiations between the proponent and Traditional Owners.
