I refer to Building and Energy receiving numerous customer complaints for Nicheliving and Inspired Homes and the volume of complaints and distress of homebuyers evident in social media posts, and I ask : (a) Did Nicheliving and Inspired Homes advise the Building Services Board of their financial difficulties; (b) Why did Building and Energy not use the powers vested in them to resolve these matters rather than having extensive media coverage lead this government to take action in the public’s interest; (c) How many BGC homebuyers are still waiting over 5 years for their homes to be finished while struggling to pay high private rents and their local government rates etc for unfinished homes; (d) Why is Building and Energy or this government taking no action in the same manner as for Nicheliving and Inspired Homes against BGC in the interests of the homebuyers; and (e) With BGC still trading and building, is 5+ years an acceptable time period to wait for a house to be completed?

(a) No.
(b) The Building Commissioner addressed all complaints under the Building Services (Complaint Resolution and Administration) Act 2011 (BSCRA Act) relating to Inspired Homes and Nicheliving in accordance with statutory processes, including issuing building remedy orders, consent orders, and referring matters to the State Administrative Tribunal where appropriate.
(c) This data is not collected.
(d) Complaints under the BSCRA Act involving BGC entities are being addressed by the Building Commissioner in accordance with statutory processes.
(e) Homeowners who believe their building contract has been breached may lodge a complaint with the Building Commissioner under the BSCRA Act.
