In regards to the WA Athletics Stadium's new track, can the Minister please advise: (a) why was the previous track replaced two years ahead of its scheduled replacement time; (b) how was it determined that the government pay 56 percent of the cost of the new track, and the manufacturer pay 44 percent of the cost as compensation for the quick deterioration of the old track; (c) what was the problem with the track that led to its quick deterioration; (d) what were the terms and conditions, if any, imposed on the manufacturer of the old track in the way of any warranty or guarantee for its quality of performance; and (e) who designed the old track and what were the specifications for its construction?

(a) The WA Athletics Stadium Track had deteriorated to a level that made it unusable for elite competition and training.
(b) Under the contract with the suppliers (Mondo) the life span of the track was estimated to be between seven and eight years. The contract warranty provided for full track replacement at a sliding scale from 100% at end of year 1 to 0% at end of year 5. As the claim was in year 4, the translation of the sliding scale put the replacement between 50% and 75% of a reasonable expectation of usage. It was negotiated that 56% represented a fair contribution from VenuesWest given the positive performance of the track in the first half of its expected life.
(c) The track suppliers confirmed that there was a manufacturing fault involving the dye used to colour the track which reacted adversely to UV rays. This affected all tracks manufactured in ochre colour over a certain production period.
(d) The warranty provided for the full replacement cost of the track by Mondo UK if the track failed to perform or showed excessive deterioration within the first year, sliding to a $0 contribution by Mondo at the end of year five. The new track has the same warranty commencing from 1 February 2014.
(e) The original track was designed by Cox Architects to IAAF specifications for international competition and achieved an IAAF Class 1 certification in 2009.
