I ask this question without notice for which some notice was given on behalf of my colleague Hon Robin Chapple, who is unfit and unable to attend this afternoon’s session. I refer to question without notice 348 asked on Tuesday, 12 November. (1) Does the minister consider that the transfer referred to in part (1) of question 348 amounts to a change in conditions or procedures under section 46 of the Environmental Protection Act? (2) If yes to (1), has the procedure in section 46 been commenced in respect of this proposal? (3) If no to (1), why not? Does the minister intend that the State will be the proponent for this project; and, if so, when is it intended that the project will commence? (4) How does the minister define the term “proponent”? (3) Section 46 of division 2, “Implementation of proposals”, of the Act deals with the amendment of conditions and procedures, and, as this has not been requested, section 46 does not apply. The Western Australian Government, through the Minister for State Development, is the interim proponent for the M2 portion of the Ord stage 2 project, but it does not intend to develop it.
