Further to the Treasurer’s answer to Question on Notice No. 3145, the duty of confidentiality imposed on the Commissioner of State Revenue by section 114 of the
Taxation Administration Act 2003
is not applicable in this instance. Between 1988 and 1998, the Murray Shire did not own Lot 81 Gull Road, Nambeelup. On 31 July 1998 a court order was given to reinstate the ownership of Lot 81 to the defunct Lakes Road Pastoral Co. Pty Ltd, in order to pay alleged outstanding monies to its director, Mr McNally. Given this fact, I ask:
(a) was land tax paid on Lot 81 between 1988 and 1998; and
(i) if so, by whom; and
(ii) if not, why not?

The Commissioner of State Revenue has advised that section 114 of the
Taxation Administration Act 2003
imposes a duty of confidentiality on him and prevents him from disclosing information obtained under a taxation Act. None of the statutory exemptions that would allow disclosure under section 114(2) or (3) are applicable in this instance.
