In their application to proceed with tenure change to the Wattle Downs Pastoral Lease - Special Lease 3116-11748 - which is currently held by the Yawuru Aboriginal Corporation, the Department of Planning and Infrastructure has recently written indicating that they do not intend to proceed with any tenure change to the Wattle Downs Pastoral Lease until after the Federal Court decision is handed down. This letter is in response to a recent enquiry from the Kimberley Land Council.

The Kimberley Land Council, representing the Rubibi Native Title Applicant Group (Rubibi), wrote to the Department for Planning and Information (DPI) in March 2005 informing DPI that "...Rubibi still strongly assert their native title rights exist over Wattle Downs". That issue has now been resolved following negotiations between the Office of Native Title and DPI and the application for a perpetual lease to Yawuru Aboriginal Corporation is being processed.
