1312. Hon AMBER-JADE SANDERSON to the
parliamentary secretary representing the Minister for Transport:
I refer to the Forrestfield–Airport
Link and an Australian Securities and Investments Commission letter to the then
Minister for Transport dated 26 February 2016 following the share price spike
in NRW Holdings Ltd.
(1) On what date did the then
minister formally respond to ASIC's letter of 26 February 2016?
(2) Has any
formal communication from ASIC to the minister's office occurred since
26 February 2016; and, if so, on what date or dates did the formal
communication occur?
(3) Has any communication from ASIC
to the minister's office since 26 February 2016 —
(a) requested additional information
from the minister; and
(b) indicated that the matter is no
longer the subject of ASIC inquiries?
(4) What is the
date of the most recent contact between ASIC and the Public Transport Authority
concerning ASIC's investigation and what was the nature–purpose
of that contact?

some notice of the question. I indicate that I am representing the
parliamentary secretary to the Minister for Transport, who is away on urgent
parliamentary business. I now provide the following answer, which I have seen
for the first time.
(1) The State Solicitor's
Office responded on behalf of the minister's office on 11 March 2016.
(2) No.
(3) Not applicable.
(4) The most
recent direct contact between the Public Transport Authority and the Australian
Securities and Investments Commission was a telephone call from the PTA's
managing director on 11 March 2016 advising that the agency's formal
response to ASIC's investigation had been forwarded to ASIC via the
State Solicitor's Office. On 15 March 2016, indirect contact was made
through the State Solicitor's Office to the PTA requesting advice for
ASIC regarding further detail about a contact identified in the original
response. This information was provided to the State Solicitor's Office
on 22 March 2016 for forwarding to ASIC.
