complaints by type and by year has the Building Commission received about the
following businesses, their associated entities and other trading names
including, but not limited to —
(a) Capital Works
Construction Pty Ltd;
(b) Freelife
Homes; and
(c) Visionaire

Freelife Homes and Visionaire Homes are trading names of Capital Works
Construction Pty Ltd. All complaints to the Building Commission are lodged
against the company name Capital Works Construction Pty Ltd, irrespective of
the trading name.
The number of each type of
complaint lodged with the Building Commission against Capital Works Construction
Pty Ltd is as follows —
(a) building
service complaints—disputes about the standard and quality of building
work—four in 2014 and two in 2015;
(b) home
building work contract complaints—disputes about a breach of a home
building work contract—two in 2014 and 19 in 2015;
(c) combined
building service and home building work contract complaints—disputes
about both the standard and quality of building work and a breach of a home
building work contract—two in 2014 and four in 2015;
(d) disciplinary
complaints—about the conduct of a registered builder—two in
2014 and four in 2015; and
(e) general
breach complaints—about the breach of other building laws—one
in 2013 and one in 2015.
(2) The building
service and home building work contract complaints that are outstanding are
being processed under the provisions of the Building Services (Complaint
Resolution and Administration) Act 2011. Four complaints have had proposed
building remedy orders issued for the building work to be completed and are
awaiting response from Capital Works Construction Pty Ltd. If no response is
received, the building remedy orders will be formalised by the Building
Commissioner.
The Building Commission's
enforcement branch is conducting investigations into Capital Works Construction
Pty Ltd in relation to the disciplinary complaints. The investigation is also
examining Capital Works Construction Pty Ltd's financial capability to
continue to operate as a builder. A possible outcome of the disciplinary
investigations is a recommendation to the Building Services Board to commence
disciplinary proceedings against Capital Works Construction Pty Ltd and any of
its directors.
The general breach complaints in 2013
and 2015 have been closed. In both cases, the investigation concluded no
offence had been committed and therefore no action was taken. The Building
Services Board has placed a condition on Capital Works Construction Pty Ltd's
registration as a building services contractor, restricting it from entering
into further building services contracts. The Building Commission is
communicating regularly with the affected clients who have contracts with
Capital Works Construction Pty Ltd.
