I refer to a black poly pipeline located both on Miscellaneous Licence L26/181 and Mining Lease 26/353 within 100 metres of 30 Brownhill Road and 17 Brownhill Road -
(1) Does the Department have the ability and control to regulate, and direct that particular matters be carried out in accordance with the
Mining Act
and Regulations to the pipeline located on L26/181 and M26/353 and also the water which travels through the pipeline when the Department has previously indicated that the operation of the pipeline is not a ‘mining operation’?
(2) If so, can the Minister explain the reasons why?
(3) If not, why not?

(1) – (2) The Crown Solicitor’s Office is of the opinion that the operation of this pipeline is neither a mining operation nor an activity that interferes with the land for the purposes of Section 20(5) of the Mining Act 1978 and in any event even if it was an interference prosecution would be undesirable.
