BORONIA GULLY LAND SALE — ABORIGINAL
HERITAGE SITE
816. Hon MATT BENSON-LIDHOLM to the parliamentary secretary
representing the Minister for Lands:
I refer to the sale of land on the Collie–Williams
road known as Boronia Gully and identified as AAD site S02103, which was
formerly owned by the Water Corporation.
(1) How and why was this land sold?
(2) At the time of purchase, was the
buyer informed that the lot contained an Aboriginal heritage site?
(3) Is the Aboriginal heritage site
still registered?
(4) If yes to (3) —
(a) was a caveat placed on the site
to preserve the heritage site;
(b) what are the rights of access for
Aboriginal people;
(c) what are the obligations of the
new owner towards the Aboriginal site; and
(d) are there
restrictions on what the new owner is able to do with the land; and, if so,
what are those restrictions?

I thank the honourable member for some notice of this
question, which I notice was submitted on Thursday, 27 September. In view of
that, I am going to have to apologise for the response.
I ask the member to place this question on notice. I am
advised that the matter does not come under the responsibility of the Minister
for Lands. The member may care to refer parts (1) and (2) to the Minister for
Water and parts (3) and (4) to the Minister for Indigenous Affairs.
