Minister for Commerce:
I refer to regulation of Sunday trading hours under the
Retail Trading Hours Act 1987.
(1) Is there a penalty to shopping centres that open before
11.00 am on a Sunday morning?
(2) If yes, what is this penalty?

I thank the
honourable member for some notice of the question.
(1) No.
However, the operators of individual general retail shops that are the tenants
within the shopping centre can be prosecuted for trading before 11.00 am on
Sundays.
(2) The Retail
Trading Hours Act 1987 prescribes the penalties for an offence of this nature
as follows: for first offence, $5 000; for a second offence, $6 000; and for a
third offence, $8 000. In the case of a fourth or subsequent offence committed
within a period of two years of the date of the last conviction, the penalty is
not less than $25 000. In cases where shops are operated by companies, these
penalties can apply to the company and also to the directors of the company.
