I refer to my question asked on 23 September and answered on 17 November 2009, regarding the Department of Environment’s response to the Supreme Court finding that prior to 25 January 2006, Hanson’s quarrying activities at Red Hill failed to comply with Ministerial directions, and I ask -
(1) Has the Minister now confirmed that the Director General of the Department of Environment is taking appropriate compliance and enforcement action under the
Environmental Protection Act 1986,
as she expected when last questioned on this issue?
(2) Will the Minister now advise what actions the Director General is taking on this issue?
(3) If no action is being taken, why not?

(1) - (3) As of 27 November 2009 the Chief Executive Officer of the Office of the Environmental Protection Authority has responsibility for monitoring compliance in relation to the implementation of proposals subject to a Statement issued under Part IV of the
Environmental Protection Act 1986
.
The Office of the Environmental Protection Authority conducts regular audits in relation to Hanson Construction Material Pty Ltd's Herne Hill Quarry Operation as approved by Statements 199 and 705 and has not identified any current non-compliance.
