DISTRICT COURT — APPEAL DECISION
372. Hon NICK GOIRAN to the parliamentary secretary
representing the Attorney General:
I refer to the Attorney General's
response to my question without notice on 28 March 2023 regarding the appeal
decision in RE AB [2023] WADC 28, delivered on 17 March 2023, in which His
Honour, in upholding the appeal of a victim of sexual assault, said at 61 —
The assessor's decision and
the process by which it was reached is, to say the least, gravely disquieting.
(1) Has the Attorney General directed that an
investigation be commenced into this prima facie case of collusion to
pervert the course of justice within the Office of Criminal Injuries
Compensation?
(2) If not, why not?

I thank the honourable member for
some notice of the question. On behalf of the representative parliamentary
secretary, I provide the following answer on behalf of the Attorney General.
(1)–(2) The
Attorney General cannot accept the premise of this question but has sought
legal advice from the State Solicitor's Office on matters raised by the
District Court's reasons for its decision in RE AB [2023] WADC 28.
