BLUE BAY MOTEL SITE, HALLS HEAD - DEVELOPMENT APPROVAL
I refer to the Blue Bay Motel site in Halls Head. (1) On what date was the recent Planning and Development Act 2005 notice of resolution clause 32 (No 63) and Planning and Development Act 2005 notice of resolution clause 21 (No 3), which changes the previous resolution from five storeys and 21 metres in height to five storeys or 21 metres in height, gazetted? (2) What was the underlying public policy that supported such a change? (3) On what date was the application approved for the Blue Bay Motel in Halls Head? (1) The notice of resolutions was gazetted on 3 November 2006. (2) The modified notice of resolutions relating to coastal buildings above specified heights was gazetted to provide further clarity. It was gazetted also to remove any uncertainty that planning applications for any development for residential - including short-stay residential - car parking, retail, office or hotel purposes, or any combination of these uses, exceeding five storeys or 21 metres in height, or both, or exceeding eight storeys or 32 metres in height, or both, if a height of eight storeys or more is permissible under the local government scheme, are required to be forwarded to the Western Australian Planning Commission for determination. The specified height criteria has not been changed and is consistent with the proposed amendment to statement of planning policy 2.6 of the state coastal planning policy. (3) The planning application was approved by the Western Australian Planning Commission on 20 October 2006 and the decision letter was sent out on 27 October 2006. (4) On 9 November 2006, proponents lodged with the State Administrative Tribunal an application for review against the Western Australian Planning Commission’s conditional approval to the development. Condition 1 of the WAPC’s approval required the height of the proposed building to be reduced from six storeys to five storeys.
