I refer to Sutherland Street in Kalgoorlie Boulder on mining tenements owned by Barrick Gold and Newmont Mining and question on notice No. 2871 asked in the Legislative Council on 12 October 2010, and I ask -
(1) Will the Minister direct and ensure through Main Roads, that the unsealed section of the road from Collier Place to Yarri Road be closed?
(2) If no to (1), why not?
(3) Can the Minister explain how the police can enforce the road traffic code on a private road which is not dedicated and gazetted?
(4) If no to (3), why not?
(5) Can the Minister indicate how many years that Sutherland Street the unsealed section from Collier Place to Yarri Road, has been operating as a private road on mining tenements without being gazetted and dedicated as a public road?
(6) If no to (5), why not?
(7) Does the Minister support through main roads the unsealed section of the above referred to road from Collier Place to Yarri Road remaining open, creating major safety concerns, along with dust and potential sterilization of significant gold mineralization resources in the area to the detriment of the wider community?
(8) If yes to (7), why?
(9) If no to (7), why not?

(1)  The road is a local road under the responsibility of the City of Kalgoorlie-Boulder.
(2)  Not applicable
(3 - 4)  It is appropriate for the information to be sought from the Minister for Police.
(5)  Yes.  The City of Kalgoorlie-Boulder, the authority responsible for the road has informed Main Roads that access has existed through this area for more than 50 years, but not necessarily on the current alignment.
(7 - 9)  It is not appropriate for the Minister to comment on a matter which is the responsibility of the local government and others to consider in terms of the benefits or otherwise of the unsealed road.
