IMPAIRED ACCUSED) ACT — REFORM
814. Hon ALISON XAMON to the Leader of the House
representing the Attorney General:
I refer to question without notice
87 asked in May 2017 and the commitment that the minister gave to introduce
substantial amendments to the Criminal Law (Mentally Impaired Accused Act) in
the second half of 2017.
(1) Given that
more than a year has passed, can the Attorney General please advise when the
amendment bill will be introduced?
(2) If not, why
not?

On behalf of the Leader of the House,
I thank the honourable member for some notice of the question.
(1) A new bill
that will entirely repeal and replace the Western Australian Criminal Law
(Mentally Impaired Accused) Act 1996 is currently being drafted and the
Attorney General expects to be in a position to introduce it before the end of
this year. As drafting continues, the Attorney General has asked the Department
of Justice to convene an interagency working group to ensure that all agencies
are fully prepared to implement the reforms in due course.
