Minister for Fisheries:
I refer to the scenario of a group fishing from a boat
unaware that one of its number is unlicensed and the group is subsequently
found to exceed its bag limit by virtue of this unlicensed fisher.
(1) Does the current legislation have the effect of
infringing the unlicensed person?
(2) Does the
current legislation have the effect of infringing the appropriately licensed
persons as exceeding their bag limit?

(1) The
regulations, which were put in place when the recreational fishing from boat
licence was introduced, were recently amended to allow for the infringement of
the unlicensed fisher and in certain circumstances the master of the boat.
