(a) The collision occurred on the Defined Interstate Rail Network which is under the jurisdiction of the Australian Transport Safety Bureau (ATSB). The ATSB are currently investigating the incident and a preliminary report is available on their website.
This section of rail network is leased to Arc Infrastructure, who are the relevant accredited Rail Infrastructure Manager under the regulation of the Office of National Rail Safety Regulation.
(b) The Rail Freight Corridor Land Use Agreement (Standard Gauge) and Railway Infrastructure Lease (The Lease) requires that throughout the term of the Lease, the Lessee will maintain, replace, repair and upgrade all leased railway infrastructure so that it is fit for purpose.
The Lease also requires that every 5 years the Lessee is to engage an independent expert to review the performance standards of the Lease and produce a 5-year Maintenance Plan showing the works, repairs, replacements, maintenance, additions and other things that are reasonably expected to be necessary. Additionally, the Lease provides for the Lessee to report any material change in circumstances. The PTA can confirm that no such advice has been received.
