I refer to the Kalgoorlie Cement Works (KCW) operated by Mr Mark Posa in Kalgoorlie-Boulder -
(1) Can the Minister for the Environment and Heritage specifically explain how the Kalgoorlie office of the Department of Environmental Protection (DEP) factually determined that the above premises do not produce more than 100 tonnes of concrete a year and are not required to be licensed under the
Environmental Protection Act 1986
?
(2) If no to (1), why not?
(3) Has the DEP ever advised person(s) that the owner/operator has accepted/ recognised the need to become licenced under the
Environmental Protection Act 1986
?
(4) If yes to (3), how did the DEP factually determine this to make that statement?
(5) If no to (3), what specifically has the DEP advised persons in relation to this matter?
(6) Can the Minister state a specific date when the DEP will ensure that the owner of KCW becomes licenced under the
Environmental Protection Act 1986

(1) Inspectors of the Department of Environmental Protection determined that the Kalgoorlie Cement Works produced more than 100 tonnes of concrete per annum, and therefore required registration. (2) Answered by (1). (3) Yes. (4) The proprietor accepted the need to be registered, with the registration completed on 15 May 2002. The City of Kalgoorlie Boulder received a carbon copy of the registration, as routinely occurs. (5) Not Applicable. (6) The site became registered under the Environmental Protection Act 1986 on 15 May 2002. Cement batching and product manufacturers do not require a licence under the Act. (7) Answered by (6).
