856. Hon SUE ELLERY to the Minister for
Planning:
I refer to the recently introduced
Swan Valley Protection Bill 2016 and the minister's comments that the
geographical area to which the bill applies ''is almost the same area as
that delineated under the Swan Valley Planning Act 1995.''
(1) What are the
exact changes to the area covered by this bill in terms of the location of land
that has been included and land that has been excluded?
(2) For land that has been newly
included in this bill —
(a) for what reasons was it included;
and
(b) who owns the land?
(3) For land previously covered by
legislation and now excluded from this bill —
(a) for what reasons was it excluded;
and
(b) who owns the land?

I thank the member for some notice
of the question.
(1) No land has
been added to the area delineated under the Swan Valley Planning Act 1995. A
total of 60.6 hectares of land has been excluded on the southern edge of the
Swan Valley area adjacent to the intersection of Reid Highway and Great
Northern Highway.
(2) Not applicable.
(3) (a) Part of
the excluded land has been used for a number of years for industrial and other
purposes that are considered to be incompatible with the planning objectives
for area B under the Swan Valley Planning Act 1995, and remains inconsistent
with the intent of the Swan Valley Protection Bill. I am advised that the
exclusion is supported by the City of Swan. The remainder of the excluded land
is located to the immediate south, adjacent to the intersection of Reid Highway
and Great Northern Highway, and is either within the primary regional roads
reserve under the metropolitan region scheme or has otherwise been removed to
avoid fragmentation of the Swan Valley area.
(b) The excluded
land includes 55 lots or part lots. The Commissioner of Main Roads owns 18 lots,
the Western Australian Planning Commission owns five lots, the state of Western
Australia owns 23 lots and private landowners own nine lots.
