(1) What are the specific ‘anomalies and issues with the documentation provided by the Shire’ to which the Minister referred to?
(2) Did the South West Regional Planning Committee consider the Draft District Town Planning Scheme No.1 (DDTPS) at its December 2007 meeting?
(3) If yes to (2), what was the outcome of the consideration?
(4) In view of the DDTPS being at the draft stage for 16 years, does the Minister consider 16 years to be an acceptable time period for establishing a DDTPS for a town experiencing high development pressure?
(5) If no to (4), does the Minister believe this to be due to the failure of the current and previous Councils of the Shire of Augusta-Margaret River to complete the Scheme in a reasonable time?
(6) Will the Minister consider taking up the available option of proceeding with the Scheme without further input from the Shire?
(7) If no to (6), why not?
(8) If yes to (6), will the Minister consider progressing the Scheme to gazettal by simply eliminating the unadvertised ‘anomalies and issues’ included by the Shire in the 2006 draft to then allow any outstanding issues to be addressed by the formal Scheme Amendment process?

(1) The main anomalies and issues for the Shire of Augusta-Margaret River draft District Town Planning Scheme No.1 were:
i) Inconsistency between the scheme format and the standard provisions applicable to all local governments and set out in the Model Scheme Text.
ii) Confusing presentations of some land use when compared to the permissibility classifications in the land use table.
iii) The provisions for Gnarabup require review and refinement to ensure they reflect the existing scheme provisions and the endorsed
Gnarabup Structure Plan

iv) Rural subdivision provisions are inconsistent with State policy.
v) There are introduced additional
'Development Investigation Areas'
, which are either inconsistent with State policies (including the 'Leeuwin-Naturaliste Ridge State Planning Policy'), or have not been given adequate justification.
vi) There is additional
rural residential
land beyond that identified in the Leeuwin-Naturaliste Ridge State Planning Policy.
vii) There are modifications to previously agreed standard structure planning provisions, which could give rise to operational deficiencies.
viii) Inconsistencies and concerns regarding tourist development provisions and zones.
ix) A provision for significant increase in the number of dwellings permitted in rural zones (counter to State policy).
x) Errors, modifications and changes to a variety of scheme schedules that need to be explained or justified in accord with planning practice.
xi) The absence of a justification for the Shire's alignment of the proposed Eastern Perimeter Road, which alignment has been the subject of ongoing and detailed consideration by various government agencies.  AND
xii) Inconsistencies with the
Leeuwin Naturaliste Ridge State Planning Policy
population thresholds and town-site expansion areas.
As indicated in the answer to Question on Notice 5586, the Shire responded to these issues by submitting a revised scheme to the Western Australian Planning Commission in early 2007.
(2) & (3) In December 2007, the Commission considered an interim report on the latest version of the local planning scheme and local planning strategy, and commented to the Shire on the significant issues and errors that still exist. The Planning Commission supported the on-going endeavours by the Department for Planning and Infrastructure to resolve these matters prior to a formal consideration of the Scheme and recommendation to the Minister for Planning and Infrastructure.
(4) The proposed Local Planning Scheme has not been in preparation for 16 years, as suggested. Previous schemes have been prepared and abandoned by subsequent Shire Councils and cannot be construed as the current scheme. Development pressures within the Shire have been accommodated through amendments to the current Local Planning Scheme and guided by State planning policies, particularly the
Leeuwin Naturaliste Ridge State Planning Policy
.
(5) Whilst it is highly desirable for local planning schemes to be prepared in a timely manner, it is equally important that they address the local planning issues, are consistent with State Planning policy, be correct and reflect the collective aspirations of the local community.  More recent delays have primarily occurred due to:
i) Significant redrafts of the scheme by the Shire, after advertising for comment, to reflect the changing Council and community aspirations.
ii) Subsequent re-assessment of the Scheme to ensure that it is consistent with State policy and best planning practice.
The recent delays of 2007 are considered reasonable, particularly to ensure appropriate and good planning outcomes.
(6) & (7) The Local Planning Scheme is currently before the Western Australian Planning Commission for consideration. The Commission's ongoing consultation with the Shire to address and reach agreement on these important outstanding matters is supported. The Commission will make its recommendation to the Minister for Planning and Infrastructure as soon as is possible.
(8) The suggested removal of the
unadvertised anomalies and issues
is not supported as that would make the scheme in-operable and not reflect current planning aspirations for the Shire. The 2007 draft Local Planning Scheme is the current version and the basis for discussion, review and improvement. In view of the significant progress and modifications already made by the Shire and with the recommendations from the Planning Commission, it is likely that the current re-draft will be advertised for further community input.
