1070. Hon ROBIN SCOTT to the minister representing the
Minister for Mines and Petroleum:
I refer to the mining activities of
Hawthorn Resources on all its mining tenements on Pinjin station.
(1) Can the
minister provide specific dates and times of site visits in the last 14 months
and what noncompliance matters or matters requiring attention were identified
on each occasion?
(2) Why have the
departmental investigations to date not been able to identify the pastoralists'
water mains severed by mining operations on mining lease 31/79?
(3) Can the
minister explain why the department did not adopt a proactive approach,
insisting and requesting in the same manner as other prospectors have been
requested that the mining proposal or program of work be amended or that
written consents be obtained under section 20(5) of the Mining Act 1978 prior
to approving the mining proposal dated 26 November 2015?

I thank the member for the question.
The following information has been provided to me by the Minister for Mines and
Petroleum.
(1) Inspections
were undertaken on 9 November, 14 November and 13 December 2017, and 24 January,
26 June, 12 July, 24 and 25 July and 26 September 2018. A direction to modify
was issued to Hawthorn Resources under regulation 120H of the Mining
Regulations 1981 after the inspection on 14 November 2017. The direction was
issued to address excessive levels of dust originating from the mining
operation. An improvement notice was issued under the Mines Safety and
Inspection Act 1994 during the inspection on 26 September 2018. The notice was
issued to address potential and personal hazards associated with a main fuel
storage tank.
(2) The
Department of Mines, Industry Regulation and Safety has investigated complaints
from the pastoralists relating to mining activities impacting on the water
supplies, including water pipes. The department is of the view that the company
is in compliance with the tenement conditions.
(3) The
department advises that it has used the same approach as for other mining
proposals and programs of work in relation to activities that may encroach on
land protected under section 20(5) of the Mining Act 1978. Matters raised in
section 20(5) are separate to the decision to approve a mining proposal or
program of work.
