Yes. 2.1 2001 and 2002 Court Proceedings (i) There were 21 prosecutions under S.156(16)(a) of the Electoral Act 1907 , for failure to vote without a valid and sufficient reason. · One was withdrawn · One was dismissed · Nineteen resulted in convictions (ii) One complaint was made by the Electoral Commissioner under s.4.87 of the Local Government Act 1995 , for failure to authorise election material. · This complaint resulted in a conviction. (iii) The Electoral Commissioner was named as a defendant in a court action commenced by Ms Judy McEvoy, in relation to the Electoral Commission’s investigation of matters arising from the 1999 City of Perth election. This matter has since been discontinued by the plaintiff. 2.2 2003 Court Proceedings (i) There were three prosecutions under s.156(16)(a) of the Electoral Act 1907 . · One was withdrawn · Two were dismissed (ii) There were 2 complaints under s.4.87 of the Local Government Act . · One resulted in a conviction · One is still in progress
