Yes. 2.1 2001 and 2002 Court Proceedings (i) There were 21 prosecutions under S.156(16)(a) of the Electoral Act 1907 , for failure to vote without a valid and sufficient reason. · One was withdrawn · One was dismissed · Nineteen resulted in convictions (ii) One complaint was made by the Electoral Commissioner under s.4.87 of the Local Government Act 1995 , for failure to authorise election material. · This complaint resulted in a conviction. (iii) The Electoral Commissioner was named as a defendant in a court action commenced by Ms Judy McEvoy, in relation to the Electoral Commission’s investigation of matters arising from the 1999 City of Perth election.
