I refer to the new planning model scheme text, and ask: (a) how many local governments have adopted the new scheme text: (i) will the Minister list each local government and the date on which the scheme was adopted; (b) please list those local governments which have not adopted the new scheme text and the date of their most recent planning scheme; and (c) is there a requirement for all local governments to adopt the new scheme text: (i) if so, what is being done to ensure compliance with this requirement; and (ii) what are the consequences of a failure to comply?

(a)-(c) The Planning and Development (Local Planning Schemes) Regulations 2015 (LPS Regulations) do not require the Model Provisions to be adopted in their entirety. The Model Provisions are a template for elements of a scheme which can be altered, varied or excluded in the preparation of a new scheme or scheme amendment, subject to Ministerial approval.
